Belleville Officials Begin the Process of Banning AI Data Centers Across the Township

Belleville Officials Begin the Process of Banning AI Data Centers Across the Township (Newark Brick City News)

Belleville officials have started the process of banning AI data centers throughout the township, following resident concerns about noise, energy use and other quality-of-life impacts, according to News 12 New Jersey reporting summarized in The Montclair Girl's Nov. 1 Essex County news roundup, read in full this run.

Belleville's move is part of a much wider New Jersey pattern. Nearly 100 municipalities in the state have adopted ordinances banning data center development, according to an October analysis of the legal landscape in the Mid-Atlantic Real Estate Journal, read this run; because New Jersey is a home-rule state that lets each municipality adopt its own zoning rules, local ordinances are generally given deference by the courts, the analysis noted, though some of the prohibitions have been challenged in court.

At the state level, the same analysis reported, Governor Mikie Sherrill has announced that data center development will require the facilities to fund and develop reliable energy sources for their projects, report on energy and water consumption, and provide communities with local investments to offset the projects' impacts — a framework implemented in part through the Data Center Fair Share Act adopted in July. Belleville's process begins against that backdrop; no final ordinance or vote in Belleville had been reported as of Sunday.
